Down Under USA Sports Tours
Operated by Down Under USA Sports Pty Ltd
ABN 25 696 407 520 Effective Date: September 2026

These Booking Terms & Conditions apply to bookings made with Down Under USA Sports Tours.

By making a booking or payment with us, you acknowledge that you have read, understood and agree to these Booking Terms & Conditions. Where you make a booking on behalf of other travellers, you confirm that you are authorised to accept these conditions on their behalf.

1. About Us

Down Under USA Sports Tours is an independent sports travel provider specialising in sporting event tickets, hospitality experiences, accommodation and associated travel arrangements.

We are not affiliated with or endorsed by the NFL, NBA, NHL, NCAA, individual sporting teams or other sporting organisations unless expressly stated.

Where tickets, hospitality or other services are supplied by an official or authorised third-party provider, those services remain subject to the applicable supplier, event and venue conditions.

2. Our Services

We arrange and coordinate sporting event travel and associated services on behalf of our customers.

Depending on the booking, these may include:

  • sporting event tickets

  • official hospitality experiences

  • accommodation

  • transportation

  • sightseeing and activities

  • hosted experiences

  • domestic or international travel arrangements where specifically included

The services included in your booking will be those specifically identified in your quotation, booking summary, invoice or itinerary.

Anything not expressly stated as included is excluded from the booking.

3. Booking Requests and Confirmation

Submitting an enquiry, receiving a quotation or asking us to hold an option does not create a confirmed booking.

A booking is confirmed when:

  1. you have accepted the applicable booking details and these Booking Terms & Conditions;

  2. the required deposit or payment has been received; and

  3. the relevant supplier has confirmed the requested inventory.

Until supplier confirmation has been received, all tickets, accommodation, hospitality and other arrangements remain subject to availability.

If the selected arrangements become unavailable before confirmation, we will advise you and may offer an alternative. If no suitable alternative is accepted, any payment made for the unavailable component will be returned where applicable.

4. Lead Traveller

The person making the booking will be treated as the Lead Traveller.

The Lead Traveller is responsible for:

  • providing accurate traveller information

  • ensuring all travellers are aware of the booking details

  • communicating payment deadlines

  • providing these Booking Terms & Conditions and relevant supplier conditions to all travellers

  • informing us promptly of changes or special requirements

The Lead Traveller must be at least 18 years of age.

5. Pricing

Unless otherwise stated, prices quoted by Down Under USA Sports Tours are in Australian dollars.

Prices are based on supplier pricing, availability and applicable foreign exchange rates at the time the quotation is prepared.

Until a booking is confirmed, prices may change due to:

  • supplier price changes

  • availability

  • exchange-rate movements

  • taxes or government charges

  • requested amendments

  • additional services

Once a booking has been confirmed and paid in accordance with the agreed payment schedule, we will not alter the confirmed price solely because of a subsequent exchange-rate movement.

Any additional services or changes requested after confirmation may be priced separately.

6. Payments

The deposit, progress payments and final payment dates applicable to your booking will be stated in your Booking Summary, invoice or booking confirmation.

Payment schedules may vary depending on supplier requirements.

Bookings involving premium event tickets or hospitality may require a substantial deposit, including up to 50% or more of the total booking value.

Payment must be received by the stated due date.

Bank transfer may be specified as the preferred payment method for high-value bookings.

Where card payment is offered, any applicable surcharge will be disclosed before payment and will comply with applicable Australian requirements.

7. Deposits and Supplier Commitments

Many event tickets, hospitality products and travel services require us to make deposits or payments to suppliers that are non-refundable.

Once your payment has been committed to a supplier on a non-refundable basis, the corresponding amount of your booking may also become non-refundable if you later choose to cancel, subject to applicable law.

Your Booking Summary or confirmation may identify specific payments as non-refundable.

Where a supplier provides us with a refund or other remedy following cancellation, we will pass on the applicable remedy to you, subject to any reasonable non-recoverable amounts or costs disclosed to you.

8. Failure to Make Payment

If any required payment is not received by its due date, we may request immediate payment.

If payment remains outstanding, we may cancel the booking or affected component where permitted by the applicable supplier conditions.

Any amounts already committed to suppliers and which cannot be recovered may be forfeited.

We are not required to use our own funds to maintain a booking where the traveller has failed to meet the agreed payment schedule.

9. Cancellation by the Traveller

All cancellations must be made to Down Under USA Sports Tours in writing.

Cancellation charges will depend on:

  • the supplier conditions applying to the booking

  • amounts already paid or committed to suppliers

  • whether the supplier permits cancellation

  • whether any part of the booking can be recovered or refunded

Where supplier payments are non-refundable, those amounts may not be recoverable following a traveller cancellation.

Any additional cancellation or administration charges imposed by Down Under USA Sports Tours will only reflect reasonable costs associated with handling the cancellation and will be disclosed where applicable.

A change of mind or inability to travel for personal reasons does not automatically create a right to a refund.

10. Changes Requested by the Traveller

Requests to change a booking are subject to supplier approval and availability.

Changes may incur:

  • supplier amendment charges

  • increases in accommodation or ticket pricing

  • cancellation and rebooking charges

  • transport or airfare differences

  • other reasonable additional costs

Some event tickets and hospitality products cannot be amended, transferred or exchanged after purchase.

No change is confirmed until acknowledged by us in writing.

11. Supplier Terms & Conditions

Your booking may include services supplied by third parties.

These may include:

  • official ticket and hospitality providers

  • event organisers

  • sporting venues

  • hotels

  • airlines

  • transport companies

  • tour operators

  • activity providers

Relevant supplier terms form part of your booking where applicable.

By proceeding with a booking, you agree to comply with the conditions imposed by those suppliers.

Where reasonably available, we will provide the applicable supplier conditions or direct you to where they can be reviewed.

12. Sporting Event Tickets

Tickets purchased through Down Under USA Sports Tours are subject to the terms and conditions imposed by the relevant ticket provider, sporting organisation and venue.

Tickets may be subject to restrictions regarding:

  • resale

  • transfer

  • commercial use

  • competitions or promotions

  • entry requirements

  • mobile ticketing

  • identity verification

Travellers must comply with all applicable ticket and venue conditions.

Unauthorised resale or misuse may result in cancellation of the ticket or refusal of admission without refund where permitted by the applicable ticket conditions.

13. Seating

Where exact seating details are available and confirmed at the time of booking, your Booking Summary or confirmation may identify the applicable section, row and/or seat numbers.

Where only a seating category is offered, the final seating allocation may not be available until closer to the event.

Venue seating maps and indicative seat views are provided as guides only.

Venue configurations, sightlines and seating allocations may be changed by the venue or event organiser.

Requests for travellers to be seated together will be made where applicable but cannot be guaranteed unless expressly confirmed in writing.

14. Hospitality Experiences

Official hospitality experiences may be operated by an event organiser, official hospitality provider or other third-party supplier.

Your booking confirmation will identify the hospitality product and main inclusions purchased.

Hospitality arrangements may be subject to change by the supplier, including changes to:

  • location

  • operating hours

  • food and beverage offerings

  • entertainment

  • celebrity, athlete or NFL Legend appearances

  • access arrangements

Where a material change occurs, we will advise you as soon as reasonably practicable and pass on any available supplier remedy where applicable.

15. Event Changes, Postponements and Cancellations

Sporting event dates, start times and venues are controlled by the relevant league, organiser or venue and may change.

If an event is postponed, rescheduled, relocated or cancelled, the applicable ticket and hospitality supplier terms will apply.

We will provide reasonable assistance in dealing with affected suppliers and arrangements.

Where a supplier provides a refund, credit, replacement ticket or other remedy, we will pass on the applicable remedy to the traveller where required.

Separate arrangements such as flights, accommodation or activities may have their own cancellation conditions and are not automatically refundable because an event has changed.

16. Event Participants and Entertainment

The appearance of any athlete, team member, entertainer, speaker, celebrity or other advertised participant may be subject to change.

Unless expressly guaranteed as a specific contracted component of the booking, the non-appearance of an individual participant will not by itself constitute cancellation of the overall travel package or event experience.

17. Accommodation

Accommodation is subject to the conditions of the relevant property.

Unless specifically confirmed, requests including:

  • adjoining rooms

  • specific floors

  • particular views

  • particular bedding configurations

  • early check-in

  • late checkout are requests only and cannot be guaranteed.

Hotels may require identification and a payment card or deposit for incidental expenses at check-in.

Travellers are responsible for incidental charges unless specifically stated as included.

18. Flights and Transport

Flights and transportation are only included where expressly stated in the booking confirmation.

Airline tickets are subject to the relevant airline’s fare rules and conditions of carriage.

Airlines and transport operators may change schedules or cancel services.

Travellers are responsible for arriving at the required departure point in sufficient time.

If a traveller misses a booked service because of their own late arrival or other circumstances unrelated to the service provider, any replacement arrangements and associated costs will generally be the traveller’s responsibility.

19. Travel Documents and Entry Requirements

Travellers are responsible for ensuring they hold all documents required for travel, including:

  • passports

  • visas

  • ESTA or other travel authorisations

  • entry permits

Purchasing travel insurance remains the responsibility of the traveller.

Travellers should consider Australian Government travel advice and any relevant destination-specific risks before travel.

Travellers remain responsible for their own decisions concerning whether to travel.

22. Circumstances Outside Our Reasonable Control

Circumstances outside our reasonable control may affect travel arrangements.

Examples may include:

  • natural disasters

  • severe weather

  • industrial action

  • government actions

  • security events

  • civil unrest

  • venue closures

Where this occurs, we will work with the relevant suppliers to identify available alternatives, refunds or credits.

Any remedy will depend on the circumstances, applicable supplier terms and rights available under Australian law.

23. Third-Party Services and Liability

We exercise reasonable care in selecting and arranging services supplied by third parties.

Third-party suppliers remain responsible for providing the individual services they operate.

To the extent permitted by law, Down Under USA Sports Tours is not responsible for a failure caused solely by the act or omission of an independent supplier or circumstances outside our reasonable control.

Nothing in these Booking Terms & Conditions excludes, restricts or modifies rights or remedies that cannot lawfully be excluded.

24. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Booking Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

Where Australian Consumer Law provides a traveller with a remedy that is inconsistent with these Booking Terms & Conditions, the applicable law will prevail.

25. Traveller Conduct

Travellers must comply with reasonable instructions from Down Under USA Sports Tours, suppliers, venues, hotels and event personnel.

A traveller may be refused participation or removed from a service where their conduct:

  • poses a safety risk

  • seriously disrupts other travellers

  • breaches venue or supplier rules

  • involves unlawful behaviour

Where a traveller is refused entry or removed because of their own conduct, unused services may not be refundable unless required by law or permitted by the relevant supplier.

26. Problems During Travel

If you experience a problem with any booking component, you should contact Down Under USA Sports Tours or the relevant supplier as soon as reasonably possible.

This gives us and the supplier an opportunity to assist while the service is taking place.

Where an issue cannot be resolved during travel, please submit the details to us in writing following your trip.

27. Privacy

We collect information necessary to arrange and administer bookings.

You authorise us to provide relevant traveller information to suppliers where reasonably required to fulfil your booking.

Personal information will be handled in accordance with applicable privacy requirements and our Privacy Policy.

28. Website, Brochures and Marketing Material

We make reasonable efforts to ensure that information published on our website, brochures, advertisements and booking materials is accurate at the time of publication.

Sporting schedules, prices, supplier inventory and package details may change.

Website and marketing material does not constitute confirmation of a booking unless the relevant arrangements have subsequently been confirmed in writing.

29. Acceptance on Behalf of Other Travellers

If you make a booking on behalf of another person, you confirm that you have authority to make the booking and provide relevant booking information on their behalf.

You are responsible for ensuring that all travellers included in your booking are made aware of these Booking Terms & Conditions and any applicable supplier conditions.

30. Governing Law

These Booking Terms & Conditions are governed by the laws of Queensland, Australia.

Any dispute will be dealt with in accordance with applicable Australian law and the jurisdiction of the relevant courts or tribunals.
